When one party feels that the judge made a mistake in deciding their case, an appeal can be filed. Family law cases are heard by individual judges, not juries, and the judges do sometimes make mistakes. The judge has a grave responsibility to not only know the law, but also to evaluate the facts. A case cannot be appealed simply because one party doesn’t like the outcome. Judges have considerable discretion to reach conclusions based on the facts they are given. But if the judge’s interpretation of the facts just doesn’t make sense, or when a judge misapplies the law, the case can be appealed.
